Data Security: Protecting Your Customers and Your Company In Dangerous Times

We have all heard of major instances of disclosure or loss of sensitive data brought about by any number of causes, including malicious software, phishing emails, ransom-ware, hacking attempts, mistaken deployment of computer equipment and improper use of the data. A data security incident can result in devastating damage to a company, its customers and potentially its principals. It can become an existential crisis for any business, large or small.

In this panel, we assemble a group of experts including lawyers in the field of digital data security law as well as engineers who specialize in maintaining and confirming the security of data processing systems and in responding to data security incidents. The goal of this panel is to provide the community with some practical insights – both legal and technical – in mitigating the risk of, planning for and dealing with data security incidents as the computing industry moves toward a cloud-based software as a service model.

SPEAKER BIOS
Aristedes Mahairas, Special Agent in Charge, Special Operations/Cyber Division, New York Office
SAC Mahairas entered on duty with the FBI in 1996. He has served as a Supervisor on the Joint Terrorism Task Force (JTTF) and Section Chief of the Strategic Operations Section in the Counterterrorism Division of FBI Headquarters. He was appointed as SAC to the NYO by FBI Director James Comey in 2015. Prior to his entry into the FBI, SAC Mahairas served as a Police Officer in New York City. SAC Mahairas received a Bachelor’s of Arts degree in Political Science from Baruch College and his Juris Doctor from New York Law School.

Randal Milch, Distinguished Fellow, NYU Law School Center
Mr. Milch was most recently executive vice president and strategic policy adviser to Verizon’s chairman and CEO. He served as the company’s general counsel from 2008 to 2014, and before that was general counsel of several business divisions within Verizon. At Verizon, Milch chaired the Verizon Executive Security Council, which was responsible for information security across all Verizon entities. Milch was responsible for national security matters at Verizon beginning in 2006, and has served as the senior cleared executive at Verizon. Milch holds a J.D. from New York University School of Law and a B.A. from Yale University.

Lenny Herold, CTO, Corsis, Inc.

Corsis provides IT security assessment services in a variety of contexts. The Corsis team is highly experienced in performing an array of IT security tests including external network penetration testing, vulnerability assessments and application security scanning. Mr. Herold is an information technology industry veteran and in his role at Corsis, Mr. Herold provides expert consulting services on wide range of topics including: infrastructure management, traditional and cloud hosting strategies, scaling and redundancy, disaster recovery planning and data security.

Ted Sabety, Principal, Sabety+associates, PLLC

Mr. Sabety is a technology attorney based in New York that services an international clientele of advanced technology and electronic media companies. He has been involved with computer-security related issues in technology transactions for over 15 years. His earliest forays in 1999 included combining data encryption and security requirements into the earliest major-label music recording licenses for internet distribution. More recently he has been involved in advising cloud-based software service businesses and customers of such services addressing cyber-related risks and negotiating cyber-security requirements with the largest IT customers and vendors in the world. He also advises clients on patents related to data security and encryption. Mr. Sabety holds a JD as well as an M.S. in Computer Science from Columbia University, a B.S. in Physics from Yale.

Jim Pastore, Partner, Debevoise & Plimpton
Jim Pastore is a litigation partner and a member of the firm’s Cybersecurity & Data Privacy practice and Intellectual Property Litigation Group. Prior to rejoining Debevoise in 2014 as counsel, Mr. Pastore served for five years as an Assistant United States Attorney in the Southern District of New York. While he was with the Criminal Division of the U.S. Attorney’s Office, Mr. Pastore spent most of his time as a prosecutor with the Complex Frauds Unit and Computer Hacking and Intellectual Property Section. Mr. Pastore was the lead prosecutor on Operation Dirty R.A.T., which targeted the creators and users of Blackshades malware, and resulted in the largest ever worldwide law enforcement action against cybercriminals.
